PAR aims to be actively involved in any policy discussion that will impact the quality and/or accessibility of services and supports for individuals with autism and intellectual disabilities in Pennsylvania. One of the ways we advocate for services and supports is through the submission of comments to draft bulletins.

Draft Bulletin Purpose
The purpose of this bulletin is to clarify the Office of Developmental Programs (ODP) policies on the provision of the Vendor Fiscal/Employer Agent (VF/EA) Intermediary Service Organization option available to individuals or their surrogates1 in the Pennsylvania Developmental Programs system who reside in their own private residence or in the home of their family. Such organizations are more recently known as Financial Management Service (FMS) organizations. While there are two FMS options selected by ODP (Vendor Fiscal/Employer Agent and Agency with Choice), this bulletin focuses on the provision of VF/EA FMS services. Pennsylvania’s Guide to Participant Directed Services (PA Guide to PDS), developed by ODP, has detailed fact sheets and agreement forms that describe the differences between the two FMS options.

Draft Bulletin Purpose
The Office of Developmental Programs (ODP) has adopted the Supports Intensity Scale (SIS) as the standardized needs assessment for participants in the Person Family Directed Supports (P/FDS) and Consolidated waivers (ages 16 – 72). The purpose of this bulletin is to describe the rollout and implementation strategy of the SIS and PA Plus and includes instruction on the use of the SIS and PA Plus in the development of the Individual Support Plan (ISP) as it relates to the waiver requirement that all ISP’s address assessed needs.

A standardized assessment helps us to understand what supports a person needs to have an Everyday Life. One standardized assessment for all waiver participants will enhance the consistency of the planning process and provides a common structure to promote consistency and accountability for all stakeholders.

Draft Bulletin Purpose
State law and general standards of practice establish standards of health care to which all individuals are entitled without discrimination. Individuals with mental retardation and mental illness have the right to receive the same health and life-sustaining treatment as offered to non-disabled persons.

Bulletin 00-98-08 issued on November 30, 1998 detailed the applicable standards for surrogate decision-making for individuals with mental retardation over the age of 18. Pennsylvania Act 2006-169 (Act 169) amended Pennsylvania’s law concerning advance health care directives and authorized “health care representatives” (see Definitions section) to make health care decisions for individuals who are not competent and do not have valid and applicable advance health care directives or court-appointed guardians of the person. In light of Act 169, this Bulletin will clarify surrogate health care decision making procedures applicable to individuals with mental illness and mental retardation who are 18 years of age or older. It is expected that health care providers will rely on this bulletin and respect the decisions of surrogate decision makers appointed according to the process detailed herein.
